 Post subject: Retailer sent the wrong item, can i keep it?

Ordered a cheap blu-ray (~£5) a while back and instead Mr. Large-online-retailer has sent me a TV series boxset (~£30).

Where do i stand legally, can I keep it? Can I flog it on eBay? Will my children still visit me in prison?

Additional fact! I've already seen the series so I've no interest in keeping it.

Legally, no you can't, it doesn't come under the unsolicited goods part as you asked for a blu-ray and got sent something that was obviously a mistake.

I had a feeling that might be the case, I doubt they'd ever work out I had it but not really worth the the 10 year stretch in Guantanamo for a Blu-ray...

I'd tell them to send me what I ordered and ask them to organise collection for the box set.

They have a good returns system, can print off a pre-paid label and shove it back to them, but the lure of crimes is strong :ninja:

If it's amazon, tell them. They'll probably send the one you wanted and say you can keep the box set. They're very good when it's them that made the mistake.

Yeah, the right thing to do is to e-mail them and explain. But, after doing so, if they make life difficult for you in any way in terms of returning the item or they do not respond in a reasonable time frame (say, two weeks) then I feel you are within your moral rights to keep it as a 'windfall' item. Life is too short to try and correct an error on the part of some super-mega corp.
