The Court of Appeal appears to have held that a pre-nuptual agreement, made in Germany, does have standing when the marriage fails, and the loot gets divvied up. Which is quite an interesting idea, but I've always thought that the existence of a pre-nup is a portent to failure, anyway, so (SNIP!- Legal Ed). Does anyone else think that? I can see the usefulness of them, but why plan to fail, anyway?

I'll see if i can get the case or not, later.

Taking out insurance doesn't mean you're getting in the car assuming you're going to crash and die.

Anyone with a modicum of common sense would know that there is always a *chance* of a relationship, however perfect, breaking up. So to save any heartache at the end you plan upfront for what happens. If the worst happens you can then have a nice amicable split rather than lengthy and costly divorce proceedings.

Despite having the pre-nup there, you can still start and go on with the relationship in a happy optimistic frame of mind assuming it won't be needed, much like your insurance.

Mrs C and I didn't have a pre-nup (obviously, as they're not enforceable) but we did, when we got engaged, have a conversation about what should happen if we did ever get divorced. Very sensible woman, Mrs C, who didn't want to get fucked over like her mum did by her dad.
