So Activision dropped Brütal Legend and Ghostbusters because they couldn't be turned into a series of yearly updates. Thats not me being cynical, thats the actual reason they gave in the press release.

Cunts.

So Tim Schafer found someone else to publish it. Woo!

Everyone has said it looks awesome and it's coming out this October and Jack Black is in it and I loved Psychonauts and Schafer is funny and is that how you spell his name and it is supposed to be a mix of Zelda and a RTS and I'm really excitied and full stops are for losers.

Then activision realised it will make some money so are suing for $15m saying they still have rights to it.

Times are tough and Activision would prefer to not have to make everyone redundant, so are being very, very cautious in terms of what they spend money on promoting. They don't want to spend any more on Brütal Legend, but have bought some legal rights for that $15mill which they would like to enforce. They are looking for a payout to try and offset their losses on the project so far because, hey, that might make the difference between solvency and bankruptcy. How mny people do they employ? How many families would be hit if they went under? How critical were we of financial firms giving staff gold played limos as they teetered on the edge of insolvency?

Then again, Double Fine are unlikely to have made up the idea that they have the right to transfer the rights. So either there was confusion when it was negotiated in the first place, or Activision are being cunts and trying to make money out of a game they didn't bother doing the work to publish.

Fair and I don't have enough to go on at the moment.

But when you are asking me to side with the small company that consistently produces novel products versus the large company that has a bad history with innovative developers then I know who gets the benefit of the doubt before any evidence is announced.

Also activision is worth $18.9 billion and owns World of Warcraft and in the last quater made a profit of $189 million so I don't think they need to rely on suing double fine for the sake of peoples jobs.

Also: yes this is shitty fucking news of the highest order. Must be especially for EA given the huge fricken posters it had up at E3 promoting it. It's almost as if Activision waited until now to spring it to cause maximum damage to both parties.

Another thought occurs. Couldn't Double Fine counter-sue for breach of contract? Surely there was some written agreement between them and Activision along the lines of "We make this, you distribute it"? Surely?

The game got nominated for best of show at E3 before this broke.

I wouldn't be suprisied if they waited to see the reaction to the game to see if the cut of profits (which they are clearly aiming for) willl be worth suing for.

I doubt WoW is anything to do with the retail side of Activision. Didn't Activision buy the whole of Vivendi? It would still have it's own accounting and management structure, right up to the board. So it's not relevent here.

I'm not terribly surprised. I doubt Double Fine is a large enough operation to develop a third system for it. I know that Tim was a bit close lipped about the now cancelled Wii version being developed by a third party.
