After reading about the stupid girl who paid to partially melt the largest organ in her body, (http://news.bbc.co.uk/1/hi/wales/7899199.stm) and learning her mum was a Health and Safety rep, I got thinking... surely it's the girl's stupid fault for getting in the sunbed and staying in for too long. I'm sure there were H&S approved guidelines published all over the salon.

Not that I approve of tanning anyway, but that's a different argument discussion.

Besides, I'm a rebel me! Look what I did:

I don't think you can go too far with H&S warnings, considering how stupid some people are.

To be fair, the mum said "I agree it was her fault for doing it". I do also rather agree that allowing unmanned tanning salons is a little silly - especially when they're supposed to only allow over-16s.

But if they're unmanned, how can you stop kids going in? It'd be like a beer vending machine in a shopping mall.

Hmm. Great idea.

If some people are dumb enough to need "do not try to stop blade with hands" on their chainsaw, then they don't fucking deserve hands.

The cinema in Boeblingen I used to visit had a beer vending machine. I ended up pissed before the novelty wore off.

That tag is off the USB lead for an MS keyboard. I know because just yesterday, in an odd coincidence, the one on mine at work was catching my attention with its stupidity for the first time in nearly two years. I (narrowly) avoided removing it though.

I think people have got that stupid, that they can't or won't think for themselves. Hence we seem to get more H&S warnings.

Until I'd read the story yesterday, I'd never heard of unmanned salons. Well, unless you count that fried eggs in Final Destination 3.

I don't think age has anything to do with this one, to be honest.

Scrap all the signs and replace them with one huge one on every motorway reading "DON'T BE STUPID", and everyone will be covered, and nobody could sue anyone.

The weird thing about the whole H&S thing is that people whinge about it being a 'nanny state' thing. This is frankly bollocks. It's a greedy, self-serving "who can I sue for this" attitude thing - the government and companies are doing the only thing they really can to protect themselves from stupid, greedy cunts and their parasitic lawyers.

Agreed also.

We need to follow what the U.S has done. Basically any work related accident is now covered. However, you get, fuck all !

They set you up with a private health care company who treat your injuries and pay your wages - 20%.

I had an accident at work whilst in the U.S involving a broken keyboard drawer's metal rail and my knee. It was summer and I had shorts on, was doing the night shift.
I went to get up in the morning and this piece of metal stuck my knee and split my kneecap. I was tired, and I'm quite heavy and clumsy when I'm tired.

Within a week I had had a x-ray, MRI and god knows what and was all lined up for a prostetic synthetic kneecap. Sadly I was due to move to Ohio and had to go, so I chose to forfeit the 'workman's comp'.

But basically in N.J now you cannot sue people. The govt got sick of it and stopped it and now you are protected but you don't make money out of it. Oddly fat hippo like women seem to be falling over alot less now. Living on WMC with a painful knee and -20% made it really hard for me. I certainly wouldn't have chosen to do that to myself.

It's these fucking ads that piss me off. The 1-800-FUCK-EM type. Some dumb fat woman who looks like a hippo falls over in those ridiculous shoes on a tiled floor (serves her right, tart) and then fucking sues the company?

It's disgusting. Any 'real' accident, as has been pointed out by SA is plain stupidity. And whilst I don't feel people should suffer or lose because of an accident they certainly should'nt get a nice fat paycheck for it.

FFS what's the world coming to?

Heh.

One would be surprised what some people get up to in the way of injuring themselves. Mind you, I don't think people put themseves in danger, with the intent of sueing, it jsut happens to be a byproduct.

Yeah, but that's just it. If you did something a bit daft and got hurt, you'd be hurt and move on with your life, because you were daft and that's the way it is. If you were acting particularly stupid, you'd be too embarassed to say anything. Now though, it's too often an instant "somebody should have told me not to be really, really stupid! Cash please."

I like that advert with the guy who used to be on The Bill. "They're real lawyers!" - presumably to distinguish the company from all those law firms staffed by shop mannequins dressed in old suits being moved by strings.

"I was installing a fire alarm and I'd been given the wrong type of ladder. Instead of one made of aluminium, mine was made of moonbeams held together with CheeseStrings®. Obviously this was not correct, but instead of saying this to the dude that gave me the ladder I thought "Hmm, there's blame... there must be a CLAIM!" and climbed the crazy abstract ladder anyway. Needless to say I fell 400 feet into the newly installed spiked pits and mildly impaled myself violently. I got £400 after 6 years of legal wrangling and the firm took 60%. Bollocks"

There was a case where an IT worker was sent to fix some IT stuff for a customer. He went there and the IT stuff was 8 feet off the ground. The ladder was 5 feet. He fell off the ladder and his employer was held liable.

Yep. The employer should've provided 8ft ladders. ;)

I'm pretty sure if I stood on a the highest safe step of a 5 ft ladder, I could reach something 3 ft higher. In fact I could probably stand on the 1st or 2nd step of any ladder and reach something 8 ft high

Good point. Still, working 8ft up, he should've had someone footing the ladder.

The employer has a duty towards his employee with regards to his safety, even off site.

But the H&S regs are pretty clear that the employee is both entitled and required to apply his own judgment to potentially dangerous situations.

Just don't start mentioning Risk Assessments and Method Statements as I'll probably cry.
(The company I work for does H&S and I'm working on an online thingy for Risk Assessments and the like so I'm rather sick of the sight of them)

I think its just people becoming more stupid and having less common sense.
So they need to be told that jumping on train tracks is dangerous or that sitting in a bed of UV light will do serious damage.

H&S is a pain in the arse, but its just a way for places to cover their back if people disregard the rules

A nightclub was found to be liable when, after an altercation where he got a kicking, a bouncer left the door, went home, got a knife, came back 20 minutes later and stabbed someone, paralysing them.

The girl was 14, though. If it were an adult it would be inexcusable, but a child might not know.

Yes, because a 14 year old child should never leave their parents side.

Bouncer was 'acting sufficiently in the course of his employment, and not off on a frolic of his own'. I'll try and find the case later, as I've not my notes with me right now. Short of it is, he was seen to be operating sufficiently within the grounds of his employment (being a bouncer, cracking skulls, etc) and not off on a frolic of his own (Guy in the West Indies, loon, was a policeman, made Othello look sane, went to police station, got changed out of his uniform, and took a boat two islands over, to check on his girlfriend, who was a witress. he saw her tlaking to another man, and shot at her, missing and hitting a tourist, Chief of police was not liable as this was a frolic of the policeman's own.).

14 year olds aren't children. And while I would be more lenient with teenagers than I would with real people, "being fourteen" still isn't an excuse for being that ignorant. It's a sunbed. Too long in sunlight, simulated or not, will cause sunburn. Nine year olds know this.

My 5 year old knows this, and has done since at least last 2 years ago (when I was on the beach too long without sun protection, and ended up with a very (very) burnt face)

I thought they weren't allowed under 16s anyway on them? Why the hell you want to submit your body to that kind of torture is beyond me, whats wrong with being all pasty white like me and the Milky Bar kid?

I can't believe they have unmanned ones, I've never heard of that before!

That's the answer.

Let kids feel pain, humans learn from mistakes! Let them be bored, humans find entertainment in each other! Let them feel disappointment, it builds ambition!

I may be making a different point here...

I believe one of the Scandavian countries -- Sweden, perhaps -- has a saying that translates as "a childhood without broken bones was wasted". They have a very different view of how children should be allowed to explore the world.

I've told you before not to call me that.

Mind you, it was like Clarkson was saying on Top Gear one day. We need 'danger' as years ago there was when we were hunting for food and such and now there isn't any 'real' danger like that. Just daft things we do to ourselves to get that 'rush.' Obviously not so in the case of the sunbed, but in general this is why people do daft things. They try and create excitement in their lives as it's a primal instinct anyway

Edit: :DD you are positively tanned next to me dear :P
