After some advice...


I rent my house out and I am looking to move back in on the 1st August.
I share a house at the moment, and one of my housemates I want to kill!!

The estate agents have told the tenants I want to move back, and have given 2 months notice. The Tenants have said they are away for summer and asked if they can stop till October.

Not sure what to do.....

If you're on a rolling contract, you can kick them out with notice. If you are on any other contract, then you need to honour the end date unless my mutual agreement, I imagine.

I know that was part of the reason my tenant paid for a year in advance, they had just had a kid and didn't want to be able to be booted out on a whim with relatively little notice.

Did I imagine it, or are there even plans in the future to stop rolling contracts after the initial short hold runs out?

But yeah what they said I am renting currently and can't be kicked out for 6 months as per my tenancy agreement.

No, you still need to give two months notice and it's still from the end of the current contract; it's just that the current contract end date can't be more than a month away because it's only ever a month long.

So, in my current situation which is the same as Kovacs', I told my letting agent to give notice at the start of May. My tenant is on a rolling monthly contract which renews on the 26th of each month so I can't get back into my flat until the 26th of July i.e. their contract at the time took them up to the 26th of May + the two month notice period.

Assuming this all the works the same way in England as it does in Scotland of course...

I'm surprised you let them go back to France - won't that invalidate your insurance due to the house being unoccupied for such a long time?

Anyway, clearly the solution is to double the rent for the two (three) months extra they want to stay.

Shouldn't do. Landlord insurance is for the building and limited contents, i'm 99% sure mine has no conditions about continuous occupancy.
It'll probably invalidate their contents insurance though.

Ah, yes, I did indeed. Although technically you can kick someone out with notice even if they're not on a rolling contract, you're still just waiting for their current contract to end but you could just be waiting a much longer time.

Looks like you can get them out for when you want under the contract

Just need to make it clear and have the estate agent manage it.

Worst case you have to clear their stuff out of your house and if your nice store it, but that can come out of the bond.

If you want to say no to October make sure that's clear and they agree and that they understand what will happen if they piss off to France before leaving your house.

Presumably they haven't left yet as it's still May. Could you let them go before the 12 months are up, letting them off a little rent, and they clear our before leaving for France? That would seem to be equitable.

They have been in for a few years, they are on a rolling month contract.

I was waiting for summer, so it would not disrupt their child at a local school

Did I mention that my tenants reported a sinkhole in the back garden, with a long crack in the ground running towards the house. Me being 300 miles away, all I could do was pay for a local handyman dude to go and have a look and dig around a bit, while I looked into who the fuck I needed to call to get it sorted out!

It was a mole hole.

£1,300 owed to the electricity company, £300 owed to the water company, £800 owed to the council tax people, £70 owed to TV Licensing...

Electricity company threatened to cut me off until I reiterated to them that it was a tenant and not me, but they seem OK now.

I bid them good luck getting their money back though, judging by the number of threatening looking letters that are still turning up for them, they're running hard.
