 Post subject: My wife had a car accident. Who's at fault?

Don't worry.. She's alright. Just a bit shaken.

Anyway, she was waiting at a 4 way junction with traffic lights and pulled away when the lights turned green.

Unfortunately, the car to her left who was going straight on also waited at the red light.. then went when it turned green.

The only problem is, the lights turned green at the same time meaning the cars collided. I saw this when I went to sort it out and it was indeed true, every other rotation the traffic lights went out of sync.

I’ve emailed the council this morning and explained in more detail the problem with the lights but I’m wondering what will happen with insurance etc? My wife has reported it along with the guy she collided with but the insurance people say it’s joint fault at the moment.

It’ll be interesting to see if the council admit they was a problem with the lights, and to see how the insurance people respond. I'll keep you posted!

It'll be joint fault. The lights shouldn't have changed together, but both drivers should have been able to avoid a crash given they were going from a standing start.

I tried taking a video but since it was late at night, there wasn't enough cars to show it.

The lights are obscured on one corner by a building that's right on the pavement too so it was impossible for the wife to see around the corner until it was too late.

It'll be joint fault I would expect. The fact that the lights are fucked is awful, and there may be some traction in getting compensation of some kind from the council, but for insurance purposes it still falls down to driver responsibility.

Thanks for your well wishes everyone. It's going to be a long road going through the council for compensation and since the damage wasn't major, I don't know whether I'll bother. It would be nice for them to say there was a fault and if they do, I'd be happy with that.

My wife is 13 weeks pregnant so we went to A&E to check her out just in case but she's fine. It did mean I didn't get home till 4am though so I'm a little tired today.

Arf, double glad then. At the end of the day it's only a car and easily replaced. Cheerfully though I imagine the foetus is cushioned at all times by the human equivalent of a crash helmet :)

Yes I did. I had it on the way home from work. The gravy was actually liquidy rather than cream sludge. This made me happy.

Thanks! I was a bit concerned like anyone would having a phone call at 11pm, hearing your wife in tears saying that 2 boys were shouting at her. They calmed down pretty quick luckily though.

I can't blame them for being a bit annoyed though, they thought she'd gone over on red.

Highway code states that green doesn't mean "go", it means "proceed if safe". However I suspect it was safe when she set off.

Surprised they hit each other, though - they must have been going fairly slowly.

[edit]Thinking harder - where did the cars hit each other? Like, one's nose into the others driver's door, or front-left to front-right...

@Grim... The damage says they were going pretty slowly too so I'm a little surprised how they managed it but still.. it is a blind corner with that building in the way so I can see how she wouldn't have seen him till it was too late.

The cars hit pretty much corner to corner.
