According to Durrant, when these abuses were reported to the Microsoft human resources department, the company did little to help him, apparently telling him they would circulate an email reminding employees of the company policy -- but they never followed through. When he inquired as to why it hadn't been sent a few weeks later, he was supposedly told that Microsoft would have to draft policy on the matter first. He told the Telegraph, "I was very surprised that Microsoft did not have any policies relating to this sexual orientation harassment." Less than a month ago we found out that the Microsoft Xbox Live team also have little-to-no policy written regarding sexual orientation discrimination.

When asked for more information, both Microsoft and Mr. Durrant have said they cannot comment on the still pending litigation. We'll have to wait until the London South Employment Tribunal hears his case "later this year" for more info.

The Kotaku comments thread on this makes for depressing reading. "OMG MAN UP U FAG JEEZ WHAT A WHINY CRYBABY", "ST00PID FAG JUST LOOKING TO MAKE A QUICK BUCK", etc. I've never seen such a shower of cunts on that site before.

I really can't tell whether there was anything directed at him or not, from that article.

Yeah, that doesn't really make much sense. Were they emails to him? Scrawlings on the notice board?

I'm amazed that the HR department didn't take this more seriously, especially at a US owned company. I can half believe they might not have a formal policy, but given that the company can be liable for harrassment you'd have thought they'd have wanted to put a stop to it. Out of concern for their money if not common human decency (not a currency with much value in a lot of HR departments, but still).

I'm amazed that managers can't seem to react to situations without policies. Surely anybody in the chain of command could've seen all of this and though "hang on a sec!" at some point.

If it's not illegal then they can't do anything to you if it's not in breach of your employment terms. Hence the policies, which are incorporated into your employment contract. See for example IT usage policies.
